Content Policy

Kaiilu is a platform for creating and consuming live and on-demand content. This Content Policy establishes the rules governing all content published, transmitted, or shared on Kaiilu. Compliance is mandatory for all users and creators.

This policy applies in accordance with the Digital Services Act (DSA, EU 2022/2065), Directive 2019/790/EU on copyright, and applicable criminal law. Violations may result in moderation actions, account suspension, and/or notification to competent authorities.

1. Absolutely Prohibited Content

The following content is strictly prohibited on Kaiilu in any format and will result in immediate removal, permanent account suspension, and — where applicable — mandatory reporting to authorities:

  • Child sexual abuse material (CSAM): any content that depicts, suggests, promotes, or facilitates the sexual abuse of individuals under 18 years of age. Kaiilu is obligated to report this to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement without delay.
  • Sexual or pornographic content: any content of an explicitly sexual, pornographic, or erotic nature, regardless of format or who is involved. Kaiilu is a general-audience platform and does not permit this type of material under any circumstances.
  • Terrorism and violent extremism: content that promotes, glorifies, finances, or facilitates terrorist acts, war crimes, genocide, or organised extreme violence.
  • Hate speech and discrimination: content that incites violence or severe discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or other protected characteristics.
  • Illegal activities: content that facilitates, promotes, or provides instructions for criminal activities (drug trafficking, weapons, human trafficking, fraud, money laundering, cyberattacks, etc.).
  • Non-consensual intimate imagery (NCII): intimate images or videos published without the explicit consent of the individuals depicted, including sexualised deepfakes or AI-generated sexual content.
  • Manipulative deepfakes (non-sexualised): videos, images, or audio generated or manipulated using artificial intelligence with the purpose of falsely attributing statements, actions, or behaviours to real individuals in a deceptive, defamatory, or harmful manner.
  • Severely harmful health or public safety misinformation: manifestly false medical information that could cause serious and direct harm to public health.
  • Fully AI-generated content: content whose AI-generation percentage exceeds the threshold determined by Kaiilu's moderation system is prohibited. Creators are responsible for transparently disclosing AI use in production.
  • Doxxing: publishing private personal information about third parties (real name, address, phone number, workplace, identity documents) without their consent with intent to cause harm.
  • Swatting and threats of physical harm: false calls to emergency services, credible threats of physical violence against specific individuals, or any conduct that endangers the physical safety of others.

2. Restricted Content

The following content is permitted only under specific conditions. Publishing it without meeting those conditions may result in removal or restriction:

  • Violent or graphic content: permitted with a clearly identified journalistic, documentary, educational, or artistic purpose, with a visible content warning before playback begins.
  • Explicit language: permitted with appropriate labels, provided it does not incite hatred, harassment, or violence.
  • Political or debate content: permitted with adherence to civil and factual conduct standards. Deliberate misinformation and manipulative electoral content are prohibited.
  • Content related to controlled substances: permitted for clearly identified educational or harm-reduction purposes; promotion or facilitation of trafficking or consumption is prohibited.
  • AI-assisted content: partial use of AI tools as a support to human creation is permitted, provided it does not exceed Kaiilu's moderation system threshold and is disclosed in the content description.
  • Mental health and suicide content: permitted with an awareness, support, or risk-reduction approach. Kaiilu follows WHO/PAHO responsible communication guidelines. Glorifying, instructing, or encouraging self-harm is prohibited.

3. Creator Obligations

  • You are solely responsible for all content you publish in your space.
  • You must hold all necessary rights to any material you use (images, music, third-party video clips, software, etc.).
  • You must correctly label sensitive content (violence, explicit language) before publishing.
  • You must disclose in the content description any use of AI tools in production, indicating the type of use.
  • You must actively moderate the chat and interactions in your space during live streams.
  • You may not use your space to circumvent suspensions, give access to banned users, or coordinate violations of these terms.
  • You may not artificially manipulate metrics (views, followers, interactions) through bots or other means.
  • You may not stream live from the driver's seat of a vehicle while driving.
  • Advertising and sponsored content: you must clearly, visibly, and unambiguously disclose any commercial relationship or sponsorship using identifiers such as #ad, #sponsored, or equivalent in your content's language, in compliance with Directive 2005/29/EC on unfair commercial practices.
  • You may not publish content that simulates being an organic review, recommendation, or opinion when a third party has provided compensation of any kind (undisclosed advertising).

4. Prohibited Community Conduct

Regardless of whether you are a creator or viewer, the following are prohibited:

  • Systematic harassment, intimidation, or bullying of any user.
  • Mass unsolicited messaging (spam) in chat or via the followers feature.
  • Impersonation of other users, creators, or Kaiilu staff.
  • Participation in coordinated content or speech manipulation schemes (brigading, hostile raids).
  • Using multiple accounts to circumvent active sanctions.
  • Sharing, without consent, personal information about other users obtained on the platform.

Competitive integrity and gaming

In gaming, tournament, or competition contexts organised or streamed through Kaiilu, it is prohibited to use cheating tools, manipulate results, or sell/transfer gaming accounts or credentials to circumvent ranking or verification systems.

Abuse of the reporting system

The reporting system exists to protect the community; malicious use is prohibited. Submitting false, unfounded, or abusive reports repeatedly, or coordinating mass reporting campaigns to target a specific user or creator without genuine grounds, is expressly prohibited. Abuse of the reporting system may result in restriction or suspension of the reporting account.

5. Moderation Process

Detection methods

Kaiilu moderates content through a combination of:

  • Automated AI systems that analyse videos, images, audio, and text for violations (CSAM hash-matching, nudity detection, audio analysis, AI-generation percentage detection, etc.).
  • Human review by Kaiilu's moderation team, which oversees automated moderation and handles complex cases, appeals, and user reports.
  • Community reporting system (the "Report" button on each content page).

Moderation actions (graduated)

Actions we may take, in order of increasing severity:

  1. Formal warning to the user or creator.
  2. Removal of the specific infringing content.
  3. Restriction of features (chat, content publishing, live streams).
  4. Temporary suspension of the space or account.
  5. Permanent account suspension.
  6. Mandatory reporting to competent authorities (for illegal content, especially CSAM).

Statement of reasons (DSA Art. 17)

In accordance with Art. 17 DSA, when Kaiilu takes a moderation decision regarding your content, it will provide a statement of reasons including: the type of action taken, the facts and circumstances supporting the decision, the applicable policy section or law, whether the decision was made by an automated system or a human, and information about the available appeal mechanism.

6. Repeat Infringement Policy

  • Copyright (notice system): after three (3) valid copyright infringement notices within a 12-month period, the creator's account will be permanently suspended and content removed, in accordance with Directive 2019/790/EU.
  • Other violations: the accumulation of content policy, community conduct, or terms of service violations may result in progressive escalation to permanent suspension, depending on severity and frequency.
  • Single serious violations: for absolutely prohibited content (section 1), permanent suspension may be applied after the first violation without prior warnings.

7. Appeals System

If you have received a moderation action and consider it incorrect, you have 15 calendar days from notification to appeal.

If your account is still active: open a support ticket directly from the platform or write to [email protected] with the subject "Moderation Appeal", including the affected content or action, the reason you consider the decision incorrect, and any supporting evidence.

If your account has been suspended or deleted: write to [email protected] with the subject "Appeal — Suspended Account" from the email address associated with your account.

Timelines and resolution: we will resolve your appeal within a maximum of 14 business days from receipt. In accordance with the DSA (Art. 20), if you disagree with our resolution, you may refer the matter to a certified out-of-court dispute settlement body recognised by the Estonian competent authority (AKI) or to the competent courts.

8. How to Report Content

If you find content that violates this policy, use the built-in reporting system (the "Report" button on each content page or user profile). Our team will review all reports according to the following priority scale:

9. DSA Compliance (Regulation 2022/2065)

Kaiilu operates in compliance with the DSA. In fulfilment of its obligations as a hosting service provider and online platform:

  • We publish and keep this Content Policy up to date.
  • We provide an accessible mechanism for reporting illegal content (Art. 16 DSA).
  • We provide statements of reasons for moderation decisions (Art. 17 DSA).
  • We offer an internal complaint and appeal system (Art. 20 DSA).
  • We publish an annual Transparency Report in accordance with the harmonised models of the European Commission.
  • We cooperate with the national digital services coordinator.
  • The competent coordinating authority for Kaiilu is the Andmekaitse Inspektsioon (AKI) of Estonia: www.aki.ee.

10. Copyright and Intellectual Property Infringement

Kaiilu respects intellectual property rights. If you are a rights holder and believe your work has been published on Kaiilu without authorisation, notify us at [email protected] with the subject "Copyright Infringement" including:

  • Description of the protected work and proof of ownership.
  • URL or exact location of the infringing content on Kaiilu.
  • Your complete contact information (name, email, phone if applicable).
  • A statement that you are acting in good faith and that the information provided is accurate.

Accounts with three or more copyright infringements in 12 months will be permanently suspended (see section 6).
